By accessing or using Scaffold CRM ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including account owners, administrators, and team members.
Scaffold provides a cloud-based customer relationship management (CRM) platform designed for contractors. Features include lead management, estimating, job tracking, SMS and email communication, canvassing tools, AI-powered sales coaching, and related features as updated from time to time.
You must create an account to use Scaffold. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Subscriptions are billed on a per-user, per-month basis. By providing a payment method, you authorize us to charge your subscription fees on the billing cycle you select.
Your subscription will automatically renew each month at the then-current subscription fee, unless you cancel before the renewal date. We will charge the payment method on file for each renewal. You can cancel auto-renewal at any time from your account billing settings or by contacting hello@scaffoldcrm.com. You may choose either: (a) cancel at the end of your current billing period, retaining full access until then with no refund, since you will have used the time already paid for; or (b) cancel immediately, in which case we will refund the unused portion of your current billing period to your payment method on file, prorated by the number of days remaining. If our subscription fees increase, we will provide advance notice of at least 14 days before the change takes effect for your next renewal. California residents: This service includes an automatic renewal or continuous service offer as described above, as required by the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606). We will send you a reminder notice by email before any renewal that is for a term of one year or longer, or where required by law, and you may cancel at any time without penalty using the cancellation method described above.
You agree to use Scaffold only for lawful purposes and in accordance with these Terms. You may not: • Use the Service to harass, threaten, or harm any person • Send unsolicited bulk communications ("spam") through our SMS or email tools • Attempt to gain unauthorized access to our systems or other users' accounts • Use the Service to store or transmit malicious code • Reverse engineer, decompile, or attempt to extract our source code • Resell or sublicense access to the Service without written permission • Use the Service in any way that violates applicable law
You retain full ownership of all data you enter into Scaffold, including lead information, customer data, and business records. You grant us a limited license to store, process, and display your data solely to provide the Service. We do not claim any ownership of your data and will not use it for any purpose beyond operating the platform. Upon account termination, you may export your data within 30 days.
By using Scaffold's SMS features, you represent that you have obtained all necessary consents from the recipients of your messages as required by applicable law, including the Telephone Consumer Protection Act (TCPA). You are solely responsible for the content of messages sent through the platform and for maintaining proper opt-out mechanisms.
Scaffold and all related logos, designs, software, and content are the property of Scaffold CRM, Inc. and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written permission.
To the maximum extent permitted by law, Scaffold CRM, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Either party may terminate your account at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to access the Service ceases. We will retain your data for 30 days post-termination to allow for export, after which it will be deleted.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey.
